Copyright, Patent, etc.
« on: December 02, 2014, 06:30:13 AM »

OK, so I kind of know about patents (there's one with my name on it, not that I invented anything but I was part of a team that did).  Anyhoo, I think what I am looking for now is a "Copyright".

Basically I have an idea for a web site, I need help developing the idea but before I divulge anything to the people I ask for help I want to make sure I have the idea protected.  Not looking to protect the name but the concept of what I am looking to build, the content of the site I guess.

Does anyone here know that process?

Actually, for music I have.... its as easy as filling out a form, but I think you are wanting a patent though; however, you cannot patent just an idea, you have to patent the functionality of said idea in a working state (if we are talking about a software, or software as service on a hosted web page). It has to be concrete / tangible, not just an idea you have. I worked with some guys to do a startup for this IT monitoring software developed on java (it was saas as well), so thats my experience. You may be doing something totally different but same rules apply.

^^seek intellectual property lawyer. Randomly call a lawyers office to see if you can get some free advice. You would be surprised. I recently got construction law advice on my shotty roof construction and warranty entitlements.

yeah, it does need to be up, running, and ready to go for the patent

Here is why... back before the patent offices could keep up with the
change in technology, some people came up with the idea of recording
audio in a digital format but never had anything to show for it.

well, there are some dudes that are patent buyers once the patent runs
out and they started going after all of the podcasts claiming that they
own the rights to podcasting and sent letters to all of these different
companies and people because they were using their services.

but if you paid them moneys, they were willing to let you use the 'patent'
or idea of recording audio in a digital format.

well, you can only imagine how that plays out with a small company like
apple who makes moneys based on the subscription services that run on
their site. so i think that the cease and desist letters that were being sent
around have kind of slowed down, but that doesn't mean that some people
didn't take the bait and either shut their shit down or pay up.

so just make sure that your idea, if it is a service, software, or tangible product,
it is really put forth through and through, you have blue prints of how it works,
and anything and everything else ready to go before you try to patent.

hope that helps some
